What Is Patent Infringement on Amazon?
A patent gives an individual or company exclusive rights to a product’s design, utility, or technology. There are two main types:

- Utility Patents – Protect how a product works or functions
- Design Patents – Protect the appearance or ornamental features of a product
On Amazon, you can face a patent infringement claim if you’re:
- Selling a product that mimics the design or functionality of a patented item
- Importing or manufacturing goods that violate an existing patent
- Unknowingly sourcing from suppliers who produce infringing items
Even if the product is unbranded or generic, it may still infringe on someone’s patent.
What Happens After a Patent Complaint?
Amazon typically:
- Removes the ASIN in question
- Notifies you of the claim through Performance Notifications
- Requests a response or Plan of Action
- May suspend your selling privileges if the issue isn’t addressed quickly
Unlike other IP claims, Amazon won’t resolve patent disputes directly. You are expected to work with the patent owner or provide legal proof that your product does not infringe.


How to Resolve a Patent Infringement Suspension
- Identify the Patent Owner and Details
- Stop selling the item immediately
- Contact the rights owner to negotiate a retraction or licensing agreement
- Submit a detailed Plan of Action to Amazon
